Then you must be aware of the documents which you should obtain from seller for this purpose else you might have to face certain troubles in future. Whenever you purchase a house in a registered society, then don't forget to obtain some special required documents for registered society flats. First of all, ensure that the chain of original conveyance deed and sale deed is completing from your seller including the previous purchaser. If the seller has submitted the original deed with sub-registrar, then ask for Xerox of such deed along with the receipt issued by sub-registrar. This will give you an idea of property ownership. If you will obtain all the documents, you may face some problems while reselling such property. Properties with all documents and clear title get higher at time of sale than other properties.



Important documents for flats in registered society


  • Share certificate: Share certificate is issued by society. This tells about the membership of seller.

  • No Objection Certificate (NOC): No Objection Certificate (NOC) is also one of important documents for this purpose. This tells that co-operative housing society has no objection from sale of a particular property. Certificate also tells that the seller is not a defaulter of any kind, and no dues are unpaid by him in society. Don't forget to obtain the receipt bearing stamp for payment made to old sellers. If you want to purchase flat in an unregistered society, then take care of following factors:

    a.) Transfer permission from competent authority (development authority or society)

    b.) Copy of plan: Ask for Xerox of approved building plan

    c.) Occupancy Certificate: Ask for occupancy certificate issued by competent authority

    d.) Ask for original chain, original registration receipt or original allotment letter of previous agreements issued by development authority.

    e.) If fresh agreement is with sub-registrar for registration, then ask for original copy of receipt issued by sub-registrar along with certified to copy of agreement

Documents mentioned above can provide you a better idea of ownership of flat. You can also bargain easily after viewing all documents. Simultaneously, you can also decide the mode of payment. It is suggested to enter into any agreement after finalizing all matters. Society membership form should also be duly filled and signed. In its absence, the ownership is not completely transfer on your name. Thus, you should complete this formality also along with sale deed or agreement to sale deed.
